"SMITH/VIOGET--MARRIAGE BY HABEAS CORPUS—The
following account of a singular matrimonial transaction in San Mateo county,
is furnished by your correspondent at Redwood City: Out little town of
Redwood City as been thrown into considerable excitement by the report
that a marriage a la mode was expected to move off under rather extraordinary
circumstances. It appears that W. SMITH, esq., coroner of this county,
had courted, with success, the beautiful and accomplished daughter of the
late Capt. VIOGET, (a well known pioneer citizen of San Francisco.)
The mother being thoroughly aristocratic, and inheriting the blood of “the
old noblesse” firmly protested against any closer intimacy, and exercised
some restraint on her daughter. The lover becoming aware of the fact, sued
out a writ of habeas corpus, which being treated with contempt, the Judge
issues out a writ of attachment, commanding the sheriff to produce the
person of both mother and daughter before him, instanter. Late in the evening,
the two ladies arrived in a carriage, escorted by the sheriff, where a
scene ensued that baffles all description. The court room was crowded to
excess. On the appearance of the parties in Court, the law proceedings
were waived, and the Judge asked the young lady if she wished to be married.
The mother urgently remonstrated; daughter wept; lover pleaded “now or
never”. At last the fair one became deaf to the mother’s entreaties—stood
up, and was married. O tempora! O mores! Many of our people condemn Judge
FOX
for issuing an attachment, at a late hour, (and making it returnable that
night,) on a lone widow, who in obeying the mandate, was compelled to leave
her young children entirely unprotected on the ranch during her absence.
The mother returned home, lonely, disconsolate and heart-broken." Source:
